THE ASSIGNMENT

Under the supervision of the Legal Specialist in Tunisia, the Consultant shall carry out the following activities during the Assignment:

Component 1 : Drafting of a needs assessment report:

  •   Identify training needs and gaps that must be addressed through the competition law training with the aim to assess and address training needs both in terms of the economic underpinnings of competition law and of the theory and legal practice of enforcing competition rules.
  •  Perform contextual analysis on existing training / organizations that provide training on the competition law, acquire ToRs for the target judges
  •  Identify the judges who will be trained on the competition law.
  •  Assess the level of competence of the target judges – capacity development needs,subject areas to be covered during the training, knowledge tests – and performance of thejudges / level of application of the competition law;
  •  Risk analysis – to identify potential risks, and devise a strategy to mitigate those risks;

Component 2: Preparation and delivery of training modules

In cooperation with the National Consultant, The International Consultant shall develop the outline and prepare the content of the competition law training modules covering, as may be applicable:

     1. Foundational module on competition law for all participant (to include, e.g., key economic concepts underpinning enforcement of competition law; conceptual notions of market dominance and its abuse; defining markets, determining competition levels, analysing market power and assigning appropriate remedies; public and private enforcement of competition law).

      2. Specialised modules on unfair competition/trade practices for judges adjudicating these types of cases (unfair competition/deceptive business practices (fraud, misrepresentation,unconscionable contracts); bilateral and multilateral trade regimes (e.g. the General Agreement on Tariffs and Trade (GATT), the World Trade Organization); United Nations Commission on International Trade Law (UNCITRAL); international trade dispute resolution mechanisms; and specialised modules for those dealing with anti-trust cases(to include, e.g., anti-trust prohibitions of anti-competitive agreements and abuse of dominant position cartels, joint ventures, information exchange, IP and anti-trust; merger assessment and evaluation criteria; procedural aspects of enforcement (evidentiary threshold in the context of concerted practices, safeguards of the rights of defence in competition proceedings, access to the competition file and the role of the courts, quantification of anti-trust fines and their judicial control); judicial review of competition decisions

        3. Euro-Mediterranean agreements and EU law and practice in competition law (Euro- Mediterranean Association Agreements; EU Competition Legislation  and Selected Jurisprudence).

Component 3 : Delivery of training

In cooperation with the national consultant, the international consultant will:

  •   Co-facilitate 3 training sessions for 60 Administrative Judges (20 judges for each session)
  •   Prepare the Training materials related to the training sessions
  •   Conduct a pre-post evaluation test
  •  Draft the final report of each training session

Component 4: On-going advice and coaching to local trainers

In cooperation with the National consultant the international consultant will:

  •   Provide reasonable on-going advice and coaching to local trainers in relation to any subsequent judicial training under the auspices of the national counterparts for a period of6 months from the completion of the training.

Draft a bi-annual report related to the on-going and the coaching provided

Such advice and coaching will take place by email, Skype, teleconferencing and telephone.

 

Deliverables:

Component 1 : Drafting of a needs assessment Report:

  •   Desk review for the contextual analysis and existing work on the subject
  •   Preliminary interviews with key informants from the justice institutions
  •   Design data collections tools – and its pre testing
  •   Collect data from the target judges
  •   A needs assessment reportComponent 2: Preparation of training modules

Component 3: Delivery of module on competition law

      • –  Delivery of the 3 sessions training

TERMS AND CONDITIONS

The International Consultant, Competition Law Project will be required to render services in Tunis, and/ or from the location as determined by the Supervisor. The selected candidate will be offered a single engagement agreement contract. The selected candidate will be offered a fixed lump sum fees (in Euro) for the above-mentioned deliverables.

Critères d'éligibilité

  • A Law Degree, with admission to practice on commercial law, is required. Specialization in competition law is an advantag
  • A minimum of 7 years professional experience in legal research and training and is required. Researches in commercial law-competition law is an advantage.
  • Substantial experience of handling commercial legal matters is essential
  • Fluency in Arabic and French is required, Englishis an advantage.
  • Excellent written and verbal communication skills;
  • Very good knowledge of the Microsoft Office Suite.
  • Excellent interpersonal skills and the ability to work constructively with several internal service departments;
  • Provenability to see throught asks set and deliver results;
  • Theability to work under pressure with tight deadlines,flexibility and an entrepreneurial spirit;
  • keen sense of ethics,integrity,credibility,and commitment to IDLO’smandate.
