BACKGROUND AND THE CONSULTANCY

The new Tunisian Constitution of 2014 mandates gender equality, gender parity, protection of women’s rights, and the eradication of all forms of violence against women. Specifically, Art. 46 provides that “the state commits to protect women’s established rights, and works to strengthen and develop those rights” and declares “equality of opportunities between women and men to have access to all levels of responsibility and in all domains”. It also guarantees that the state will take all measures to eliminate violence against women. On July 2016, the Tunisian government adopted the “Integral Law to Eliminate Violence against Women” and presented to the Tunisian parliament to be adopted by the Committee of rights and liberties. The Integral Law to Eliminate Violence against Women , which is the fruit of years of struggle of the Tunisian women NGO’s and women activists, covers all forms of gender – based violence (physical, moral, sexual and economic) against women, regardless of who they are and in whatever field, without discrimination based on gender, Origin, color, race, religion, opinion, age, nationality, economic and social conditions, civil status, state of health, language or disability. This law requires legal assessment and reform to address violence against women and to ensure a more comprehensive legal alignment with the constitution.

The purpose of the consultancy is to provide capacity development tools and training on gender responsive legal drafting, especially on legislative reform priorities relating to GBV, women’s rights and gender equality. It supports the project outcome on “Improved capacity and skills of the MOWFC and other key actors on gender-responsive legal drafting, especially on legislative reform priorities relating to GBV, women’s rights and gender equality”.

Under the direct supervision of the IDLO’s Country Representative for Tunisia, in coordination with IDLO’s Senior Gender Adviser, the National Expert will perform the following duties and produce the following tasks:

  • Lead engagement with different key stakeholders to develop curriculum and training materials on legislative drafting and legislative advocacy skills,
  • Develop and finalize curriculum and training materials on legislative drafting and legislative advocacy skills (May- June 2017)
  • Lead the design of and deliver the workshop on legislative drafting and advocacy skills (July 2017)
  • Conduct a desk study to review the relevant national (Tunisian) legislation related to women’s rights (May 2017)
  • Lead in the development of and finalize the options paper on priority legislative provisions, with suggested legal texts and alternative recommendations (July-August 2017)
  • Design and facilitate expert and stakeholder consultations on priority legislative provisions (September 2017)
  • Support IDLO in capturing lessons learnt in the implementation of the project and identifies and maximizes opportunities for sustainability and scale up the project (September – October 2017).

Specific Deliverables:

  • Curriculum and training materials on legislative drafting and legislative advocacy skills, and workshop narrative report;
  • Desk review of the relevant national (Tunisian) legislation related to women’s rights;
  • Final options paper on priority legislative provisions, with suggested legal texts and alternative recommendations;
  • Expert consultations report; and
  • Final report, including on how the activities above support the project outcome on “Improved capacity and skills of the MOWFC and other key actors on gender-responsive legal drafting, especially on legislative reform priorities relating to GBV, women’s rights and gender equality;”

Specific knowledge, skills and competencies

  • Strong interpersonal and organizational skills;
  • Enthusiastic and proactive attitude in building partnerships with a broad range of stakeholders and driving results, including at the senior level;
  • Excellent communication skills, both written and oral;
  • Ability to work under pressure with tight deadlines, flexibility and an entrepreneurial spirit.
  • Ability to respond timely to queries and provide feedback;
  • Self-motivated and dynamic with a willingness and ability to use initiative to assist the Organization to achieve its objectives;
  • Keen sense of ethics, integrity and commitment to IDLO’s mandate.

TERMS

The selected candidate will be offered a Single Engagement Agreement, subject to award of the grant. For this Single Engagement Agreement, based upon satisfactory completion of the specific deliverables, the incumbent will be compensated up to a fixed lump sum and consolidated amount in accordance with qualifications and experience.

Critères d'éligibilité

  • Minimum post graduate degree in law is essential. Ph.D and/or additional degree in gender, development, human rights or other related fields will be a plus.
  • Minimum of 10 (ten) years of professional experience on women’s rights, gender and development or sexual and gender-based violence.
  • Significant professional experience on legislative drafting, legal and justice reform, capacity development/training in the legal field, is required.
  • Experience working in Tunisia on matters relating to women’s rights, violence against women, is highly desirable.
  • Experience working with Tunisian government officials, parliament, CSOs and other relevant legal actors.
  • Fluent oral and writing skills in French and Arabic are required.
  • Fluent oral and writing skills in English will be a plus.
