THE ASSIGNMENT

Under the supervision and direction of IDLO’s Legal Specialist in Tunisia, and in close collaboration with the International Consultant, the National Consultant shall carry out the following activities during the Assignment:

I. Conduct a training needs assessment of Tunisian administrative judges with the purpose to identify specific needs and gaps in terms of the economic underpinnings of competition law and of the theory and legal practice of enforcing competition rules. The needs assessment will also examine the Tunisian competition legislation to define particularly complex or opaque areas of the law, to further define the focus of the training.

For this purpose, the National Consultant will:

a) Conduct a contextual analysis, identifying and analyzing any existing data and information regarding the current and past training initiatives on competition law for the benefit of the target judges, and the lessons learned from those programs;
b) Acquire the current job descriptions of the target judges;
c) Contribute to design a methodology and tools for assessing the training needs of the target judges, to be validated by IDLO’s Tunisia team and be subsequently piloted;
d) Based on the agreed methodology and framework for the assessment, collect the necessary data to assess the level of knowledge, skills, and competencies of the target judges in relation to the training subject areas and as per their job descriptions, as well as the level of their performance in the application of competition law;
e) Contribute to identify noticeable and measurable gaps in the capacity of the target judges that need to be improved;

f) Collect data for the baseline for the key performance indicators as outlined in the program M&E framework, and collect data for the Level 3 assessment as per the IDLO guidelines;
g) Present to IDLO partner institution needs assessment findings for validation; and
h) Compile in collaboration with the International Consultant a comprehensive needs assessment report to be validated by IDLO Tunisia team, and including:

  •  A thorough presentation and analysis of the findings;
  • A risk analysis, highlighting potential risks and proposing mitigating strategies;
  • Proposed learning objectives to be covered during the training and coaching initiatives; and
  • An implementation strategy and workplan for the program.

II. Design training modules. Based on the results of the Needs assessment, and in line with the defined objectives and implementation strategy, the national consultant shall develop the training outline and prepare the content of the competition law training modules covering, as may be applicable:

  • Law and practice in Tunisia;
  • The application of international approaches to key concepts in Tunisia;
  • The types or categories of claims coming before Tunisian courts and particular difficulties they present for judges;
  • The types or categories of claims that can be expected to come before Tunisian courts in the medium-term future, having regard to the development of the Tunisian economy;
  • The discretion and remedies available to the courts to resolve claims.

Duties of the National Consultant shall include:

a) Designing in collaboration with the International Consultant practical and interactive training modules in line with IDLO’s participatory training approach and including specific Tunisia-related practical cases;
b) Developing in collaboration with the International Consultant training material, including the training handbook, handouts and reference materials;
c) Maintaining the quality of the training modules in line with IDLO training standards and ensuring their clearance by IDLO’s Tunisia team.

III. Deliver training on competition law, in cooperation with the International consultant, and specifically:

  • Co-facilitating three (3) interactive and participatory training sessions for sixty (60) Administrative Judges (20 judges for each session);
  • Distributing the training materials related to the training sessions;
  • Conducting pre-post knowledge assessment tests in cooperation with the International Consultant;
  • Ensuring that each training sessions is evaluated as per IDLO’s Training Evaluation Guidelines;
  • Drafting the final report for each training session.

IV. Providing on-going advice and coaching to participants in collaboration with the International Consultant. These will be delivered individually or in groups, either face to face, by email, Skype, teleconferencing or telephone, as per the participants’ specific needs. The National Consultant specifically will:

  • Provide advice and coaching to participants to support them in the application of the competences acquired through the Competition law training modules;
  • Provide reasonable on-going advice and coaching to local trainers (5 days) in relation to any subsequent judicial training under the auspices of the national counterparts for a period of 6 months from the completion of the training.
  • Draft a bi-annual report related to the on-going and the coaching provided.

TERMS AND CONDITIONS

The National Consultant, Competition Law Project will be required to render services in Tunis, and/ or from the location as determined by the Supervisor. The selected candidate will be offered a single engagement agreement contract

Critères d'éligibilité

  • A Law Degree, with admission to practice on commercial law, is required. Specialization in competition law is an advantage.
  • A minimum of 7 years professional experience in legal research and training and is required. Researches in commercial law-competition law is an advantage.
  • Substantial experience of handling commercial legal matters is essential
  • Fluency in Arabic and French is required, English is an advantage. Specific knowledge, skills and competencies
  • Excellent written and verbal communication skills;
  • Very good knowledge of the Microsoft Office Suite.
  • Excellent interpersonal skills and the ability to work constructively with several internal service departments;
  • Proven ability to see through tasks set and deliver results;
  • The ability to work under pressure with tight deadlines, flexibility and an entrepreneurial spirit;
  • Keen sense of ethics, integrity, credibility, and commitment to IDLO’s mandate.
