Position title: National Public Law Expert

I- Background 

The International Institute for Democracy and Electoral Assistance (International IDEA) is an international intergovernmental organization, based in Stockholm, with more than 20 years of experience in supporting sustainable democracy and sharing comparative knowledge on different aspects of democracy.

Since 2011, International IDEA has been interested in the constitutional process in Tunisia and more particularly in the guarantee of rights and freedoms in the new 2014 Constitution.

Article 49 of the Tunisian Constitution sets out the conditions and criteria for limiting the exercise of rights and freedoms in a democratic State, so that such restrictions are not abusive and disproportionate. Legal texts relating to the exercise of individual freedoms promulgated before the adoption of the 2014 Constitution must now comply with the aforementioned article 49.

Research in this regard is necessary in order to identify existing legal texts related to individual freedoms that are not in conformity with the provisions of the said article. This research will contribute to raising awareness among professionals, parliamentarians, civil society and the public of the impact and implications of article 49 on the recognition and guarantee of individual freedoms.

The services of a national expert specialized in public law are necessary in order to draw up a list of laws in force relating to individual freedoms and to analyze them in the light of article 49 of the Constitution.

II- Tasks and responsibilities

Services to be performed by the Expert:
The expert will be responsible for performing the following services:

  1. Conduct research to review the literature published in relation to article 49 of the Constitution.
  2. List the laws and regulations in force related to individual freedoms in Tunisia.
  3.  Analyze the current legal framework from the point of view of its conformity with the Constitution in general and Article 49 in particular.
  4.  Propose the necessary modifications and amendments to be introduced to the said legal framework and the appropriate modalities for its implementation.
  5. Interact by email with the IDEA team regarding the preparation of the research.
  6. Attend working sessions with the IDEA team and proceed with agreed reformulations and comments until the final validation of the research.
  7.  Speak at a seminar and present the preliminary conclusions of the publication project.
  8. Collaborate, if necessary, with the computer graphics designer proposed by IDEA regarding the form and final presentation of the publication.

Deliverables:

The Expert must provide the following deliverables:

1) In a first step (30 days from the signing of the contract):
– The context of the research,
– The problem of research and its justification,
– The inventory of published literature on the subject,
– The delimitation of the scope of the publication and its relevance to existing publications,
– Research methodology,
– The detailed research plan.
(The deadline for the final version of these deliverables in light of comments and revisions is 45 days from the signing of the contract).

2) In a second step:
– A first draft of the publication (The deadline is 90 days from the completion of the first stage).
– A second draft of the publication in light of the comments and revisions of the IDEA team (The deadline is 20 days from the notification of comments and revisions by the IDEA team).

– Present at a seminar the preliminary conclusions of the publication project. The expected date of the seminar is early May 2019.
– A third draft of the publication in the light of the comments and revisions raised at the seminar. The deadline for this deliverable is May 30, 2019.
– A final version of the publication (content and form). The deadline for this deliverable is June 15, 2019.

Language of publication: Arabic.

 

Critères d'éligibilité

  • A doctorate in public law.
  • Have a minimum of 15 years of proven and relevant professional experience in relation to the Tunisian legal context, in particular in public and constitutional law
  • Have contributed to the writing of relevant publications in public law and constitutional law, particularly on the protection of rights and freedoms (analyses, comments, doctrine articles, manuals, etc.). -
  • Have relevant and significant experience in the field of scientific research
  • Have a good planning ability.
  • Fluency in Arabic and French (fluency in English is an asset).
